What is Alternative Dispute Resolution (ADR)?
Alternative Dispute Resolution, commonly referred to as ADR, is an umbrella term for a range of processes that allow separating couples to resolve financial and family disputes outside of the formal court system. Rather than having a judge impose a decision upon you, ADR gives both parties greater control over the outcome, often in a setting that is less adversarial and more constructive.
At Goughs, we subscribe to Resolution’s Code of Practice, which commits us to handling every family matter in a way that minimises conflict and prioritises the long-term wellbeing of everyone involved, particularly any children. Going to court is always our last resort.

Alternative Dispute Resolution FAQs
In most cases, yes. Before applying to court for a financial or children matter, you are legally required to attend a Mediation Information and Assessment Meeting (MIAM). This is an initial meeting with a qualified mediator to assess whether mediation, or another form of Alternative Dispute Resolution might be suitable for your situation. It is not a commitment to mediate; simply a first step. There are some exemptions, for example in cases involving domestic abuse or where the matter is urgent. Your Goughs solicitor will advise you on whether a MIAM applies to your circumstances and guide you through the process.
It depends on the method. Arbitration produces a legally binding decision from the outset. Agreements reached through Collaborative Practice, Represented Mediation, or a Private FDR are not automatically binding, but they can be formally recorded in a consent order approved by the court. At which point they become fully enforceable. Your solicitor will ensure that any agreement reached is properly documented and legally protected.
If you are unable to reach an agreement through ADR, court proceedings remain available as a last resort. Nothing discussed during most ADR processes can be used as evidence in court, so you can engage openly without fear that it will be used against you later.
