A commercial lease is used by a tenant who is using the leased space for a business purpose. If someone is leasing a property solely to live in, then this will usually be classified as residential.

Assigning a lease is where a tenant transfers their interest in the lease to a third party. Even if a lease permits an assignment, there are nearly always conditions attached to this right. Quite often landlord’s will require the tenant to enter into an authorised guarantee agreement whereby, even though the tenant has transferred their interest to a third party, they are still “on the hook” to the landlord. A good starting point when looking to assign your lease, is to review the provisions in the lease to see whether or not this is possible and if it is, looking at the conditions that are attached to it. Usually assignment of whole is permitted in the lease but consent from the landlord must be obtained. The process for obtaining your landlord’s consent usually involves entering into a Licence to Assign with your Landlord.
