Considering a DIY WIll?
In times of austerity it may seem like a good idea to make cutbacks wherever possible - perhaps change your brand of washing powder or consider the “No frills range”.
One thing not to cut back on though is your Will. If you are considering a self written/DIY Will, you should ask yourself “Is it a prudent step or simply a false economy?”
Dawn Moir, Head of the Wills, Trusts and Probate Team at Goughs Solicitors, considers the use of DIY Wills.
I’ve heard that a DIY Will is cheaper, is this the case?
Not always; think long term! DIY Wills can be as little as £10, with professionally drafted Wills costing around £100 - £300. Although you may be saving money initially, many DIY Wills face at least one legal challenge when they come to be used. The cost of putting things right is often more than a professionally drafted Will.
Is a DIY Will valid?
Sometimes! Invalid DIY Wills are common! It’s not as simple as writing down your wishes and signing it. Many other elements can affect the validity of the Will, including:
• The order in which it is signed by you and the witnesses.
• Who the witnesses are in relation to you and other people in the Will.
• Who is present when each person signs.
• Who prepared the Will & even the position of the signatures on the Will.
Don’t forget, if any amendments are made to your DIY Will these will also need to follow certain formalities.
Do I need legal advice if I have a small estate and family?
Possibly! This depends on your individual circumstances. The more straightforward your estate, the easier it is for you to decide. However, it’s sensible to seek advice on certain aspects, such as who to appoint as your Executor or how to execute your Will correctly.
